These Terms & Conditions ("Terms") govern your access to and use of our services, including our AI-powered receptionist system, call handling services, SMS messaging features, and integrations with third-party platforms such as CRM systems, scheduling software, and telecommunication providers. By accessing our website, purchasing a subscription, or using any of the services provided by Zokun Technologies, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of the services immediately. These Terms apply to all users, customers, and businesses that subscribe to or interact with Zokun Technologies services.
2. Services
Zokun Technologies provides AI-powered communication and call-handling services designed primarily for service-based businesses, including but not limited to HVAC companies and other home service providers. Our services may include, but are not limited to: • AI-powered voice call answering • Automated call qualification and routing • Appointment scheduling and booking • SMS confirmations and reminders • Call logging and reporting • Integration with customer relationship management (CRM) platforms • Integration with calendars, scheduling tools, and business software • Call transcription and conversational AI processing • Workflow automation related to customer inquiries Our AI receptionist is designed to assist businesses in responding to customer inquiries and capturing leads when staff are unavailable or busy. However, Zokun Technologies does not guarantee that the AI will correctly interpret all customer requests, and it should not be relied upon as a replacement for human decision-making in critical situations. We reserve the right to update, improve, modify, or discontinue any part of the service at any time in order to improve performance or maintain system reliability.
3. Account & Setup
To begin using Zokun Technologies services, clients must complete an onboarding process which may include: • Providing accurate business information • Providing access to business phone numbers or forwarding settings • Providing calendar or CRM integration access • Defining service areas and business hours • Defining escalation procedures for urgent calls Clients are responsible for ensuring that all information provided during onboarding is accurate and up to date. Clients must also ensure that they have the legal right to connect phone numbers, software platforms, or other systems to Zokun Technologies. Failure to provide accurate information may affect system performance and the ability of the AI receptionist to correctly assist customers.
4. Fees and Payments
Zokun Technologies provides services on a subscription basis unless otherwise specified in writing. Setup Fees Certain services may require a one-time setup or onboarding fee. This fee covers the configuration of the AI receptionist system, integrations, call scripts, testing, and system deployment. Setup fees are non-refundable once onboarding has begun. Subscription Fees Subscription fees are billed monthly in advance and grant access to the AI receptionist services for the billing period. Subscription plans may include various service limits, such as call handling volume, integrations, or messaging capabilities. Payment Methods Payments may be processed through secure third-party payment providers and may include: • Credit card payments • Bank transfers • Online payment processors By providing payment information, you authorize Zokun Technologies to charge your payment method according to your selected subscription plan. Late or Failed Payments If payment is not received by the due date, Zokun Technologies reserves the right to: • Temporarily suspend services • Restrict access to the system • Terminate the account after repeated non-payment Service restoration may require payment of outstanding balances.
5. AI & Call Handling Limitations
Zokun Technologies utilizes artificial intelligence and automated communication systems to interact with callers. While the system is designed to perform accurately and professionally, the following limitations apply: • AI systems may occasionally misunderstand caller input • Background noise or poor phone connections may affect responses • AI may not fully understand complex or unusual customer requests • Certain situations may require human intervention Clients acknowledge that the AI receptionist is a support tool designed to assist with call handling, and clients should maintain oversight of their business operations. Zokun Technologies is not responsible for missed appointments, misinterpreted calls, or business losses resulting from AI interactions.
6. SMS & Communications Compliance
Some services provided by Zokun Technologies involve the sending or receiving of SMS messages. When SMS features are enabled: • Messages may be sent to customers to confirm appointments, respond to missed calls, or provide scheduling updates • Message frequency will vary depending on customer interaction • Standard message and data rates may apply depending on the customer's mobile carrier Customers receiving SMS communications must have initiated contact or provided consent in accordance with telecommunications regulations. Recipients may opt out of SMS communications at any time by replying STOP. Clients agree to comply with all applicable telecommunications regulations, including but not limited to: • A2P 10DLC regulations • Consumer consent requirements • Telephone Consumer Protection Act (TCPA) compliance where applicable Zokun Technologies is not responsible for misuse of messaging features that violates applicable communication laws.
7. Client Responsibilities
Clients agree to maintain accurate and up-to-date business information within the system. Clients are responsible for: • Maintaining valid business licenses and compliance with applicable regulations • Defining service availability and operating hours • Monitoring booked appointments and call logs • Responding to customers in a timely manner Clients must also provide clear instructions regarding emergency escalation procedures if urgent calls need to be forwarded to human staff. Failure to maintain accurate business information may negatively affect service performance.
8. Intellectual Property
All software, systems, AI models, scripts, algorithms, workflows, and proprietary technologies used to deliver the services remain the exclusive property of Zokun Technologies. Clients retain ownership of their own business information, including: • Business name and branding • Phone numbers • Customer information provided during calls Clients are granted a limited license to use the Zokun Technologies platform for the duration of their subscription. Clients may not reverse engineer, replicate, distribute, or copy the technology used by Zokun Technologies.
9. Data & Confidentiality
Zokun Technologies takes reasonable precautions to protect the privacy and security of customer data. Data collected through the service may include: • Caller phone numbers • Call recordings or transcripts • Appointment details • Business configuration information This data is used solely for the purpose of providing and improving the service. Both parties agree to maintain the confidentiality of any proprietary or sensitive business information shared during the course of service. 10. Service Availability
Zokun Technologies strives to provide reliable and high-availability services. However, uninterrupted service cannot be guaranteed. Service interruptions may occur due to: • Telecommunications provider outages • Internet connectivity issues • Third-party platform disruptions • Scheduled maintenance • Events beyond reasonable control Zokun Technologies shall not be held liable for losses resulting from temporary service interruptions.
11. Cancellation and Termination
Clients may cancel their subscription at any time prior to the next billing cycle. Cancellation requests must be submitted in writing or through the account management system if available. Once cancelled, services will continue until the end of the current billing period. Zokun Technologies reserves the right to suspend or terminate accounts in cases of: • Non-payment • Fraudulent activity • Illegal use of services • Abuse of the platform
12. Limitation of Liability
To the maximum extent permitted by law, Zokun Technologies shall not be liable for indirect, incidental, or consequential damages arising from the use of the service. This includes, but is not limited to: • Lost profits • Lost business opportunities • Missed customer calls or appointments Total liability shall not exceed the amount paid by the client to Zokun Technologies in the thirty (30) days preceding the event giving rise to the claim.
13. Changes to Terms
Zokun Technologies reserves the right to modify these Terms at any time. Updated Terms will be posted on the website and will become effective upon publication. Continued use of the services constitutes acceptance of the revised Terms.
